Watch out for Pitfalls! Avoid These Common Workers’ Comp Mistakes

Erwin, McCane & Daly | Friday, September 26, 2014

Workers’ Compensation claims can be complex and lengthy; they can even try your patience. Don’t give up! If you’ve been hurt at your workplace, you’re owed compensation for lost wages and medical bills.

The following are 3 Mistakes to Avoid When You Apply:

  1. Not notifying your employer immediately after your injury. Notice is required within 30 days, but the earlier notice is given helps avoid issues with credibility. Try to notify within 24 hours, which is best.
  2. Not getting medical attention soon enough. Don’t delay seeing a medical professional and asking him to document your injuries. This will be invaluable to your case down the line.
  3. That injuries must be sudden. Untrue! Repetitive stress injuries also qualify, from work activities such as keyboarding, lifting and standing on a hard surface. A claim for an injury can be filed even if there has been a similar injury in the past that was non work-related.

At EMD Law, we know all the ins-and-outs of Workers’ Compensation laws, and will guide you every step of the way. Call us today to get us on board with your case, and we’ll make it much easier to navigate through the rough waters.
